General Terms and Conditions:

1. These terms and conditions (the “Terms”) apply to all purchases of merchandise made by you through this website under the Saintistic domain (the “Website”). Please read these Terms carefully before using the Website. By using the Website, you signify your agreement to be bound by these Terms.
2. You can view the most current version of these terms and conditions at any time by visiting this page. We reserve the right to update, change or replace any part of these terms and conditions, without prior notice to you, by posting updates on this page. It is your responsibility to check this page on each visit to our website, read these terms and conditions and ensure you understand them before making any purchase.
3. Any reference to “we”, “us” or “our” refers to Saintistic web site and its owner(s) operator(s).

5. Our website offers a range of products and services for sale. Where we refer to an ‘item’ we are referring to a single product or service available for purchase on this website.
6. The products on the Website are offered subject to availability.
7. All prices are in Great British Pounds (GBP), including tax where applicable, and must be paid in full including the delivery charge which is an additional charge. Customers are liable for the customs duty and taxes prevailing in their own country, if ordered from abroad.
8. We have taken every care to ensure that product descriptions, price, colour and availability are accurate. However, there may be some changes which are beyond our control and variations that are to be expected in handmade products. Sizes, measurements and colours are given as a guide only.
9. Whilst care is taken to ensure that we display as accurately as possible appearances, colours, textures or finishes, what you will see on your computer monitor or equipment may differ, and so we cannot guarantee that images are a 100% accurate representation of the actual goods or services that you are purchasing.
10. You may not reproduce, duplicate, copy, sell, resell or otherwise exploit for commercial gain, or otherwise, any portion of any of the content on the website or any other part of the service that we offer on this website.

Orders:

11. We endeavour to dispatch in stock items within 2 to 3 working days. You will be informed of expected processing time for personalised or custom made items. In such case you are requested to contact us in advance before placing an order.
12. When you place an order you will receive an email stating the details of your order. This email is not confirmation that your order has been accepted by us.
13. Your order will only be accepted by us once your payment has been cleared and goods have been dispatched.
14. We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:
    i) The item you have ordered is out of stock.
    ii) We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent.
    iii) There has been a pricing or product description error.
    iv) There is a system or procurement failure.
    v) For any other reason which we are not obliged to disclose.

Shipping:

15. Due care will be taken to package your order with appropriate material such as card board, bubble wrap etc.
16. You will be informed by email when the item has been handed over to the delivery service provider.
17. Please understand that there are occasional delays during transit once the item has left our premises.
18. If goods have been damaged during transit, please sign for as ‘damaged in transit’ and email us within 24 hours of delivery.

Refunds:

19. By law, customers have the right to withdraw from the purchase of the goods before they are notified that any of the goods have been dispatched. In addition, you have the right to cancel your purchase within 14 working days after the date your goods have been delivered. You must notify us of your wish to cancel your purchase. You must then return the unwanted goods, unused and with the original packaging within 14 working days after notifying us of your decision to cancel. You must send the goods back to us to our contact address at your own cost. However; You will not have any right to cancel a purchase for the supply of any of the goods made to your specifications or clearly personalised or which by reason of their nature cannot be returned. Please ensure that you understand this before placing such an order. This does not affect your statutory rights.
20. The item must be sent back to the return address, and be in good condition with the original packaging. No amount can be refunded until the item has been returned undamaged and received by us. Please note that parcel remains your responsibility until it reaches us. We will then reimburse you the purchase price, within 14 working days of receipt of the returned goods.
21. In the unlikely event that your goods arrive faulty or damaged or if there is any other issue with your order, please contact us at info@saintistic.co.uk immediately. Please also state the nature of the defect and let us know if you would prefer a refund or a replacement.

Limitation of Liability and Indemnity:

22. Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howsoever caused.
23. Our liability to you is limited to refunding the price of the products as provided above. We are not responsible to you to any greater extent and in particular we shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.
24. You agree to indemnify us immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.

Legality and Enforceability:

25. Should any part-term or term be found to be void, unlawful or unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the voided, unlawful or unenforceable term was not present.

Jurisdiction:

26. These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.
